Yikiti Golf Terms & Conditions
By registering for a Yikiti Golf event, you agree to the following Terms and Conditions:
Price and Payment
We reserve the right to adjust the price of any golf event, not limited to any pricing error, and we will advise you of the current price of the event before registering.
A deposit of 10% must be paid when registering for an event. A second deposit of 50% of the event price must be paid 120 days before the start of the event and final balance must be paid no later than 30 days before the event’s start date. Registrations made less than 60 days before the event’s scheduled start date must be paid in full at the time of registering. If the deposit, second deposit, or final balance (as applicable) is not paid by the Balance Due Date, we reserve the right to cancel your booking and retain your deposits paid.
Cancellations
An email to info@yikitigolf.com is the only accepted notification of cancellations of your registration. Deposits and final balance will be refunded if cancellation is made up to 61 days prior to the start of the event. Cancellations made between 31 and 60 days prior to the start of the event will result in forfeiture of the initial deposit. Cancellations made less than 31 days prior to the start of the event will result in forfeiture of all paid deposits and final balance.
Changes
An email to info@yikitigolf.com is the only accepted notification of changes to your registration. Deposits and final balance will be refunded between 30 and 60 days prior to the start of the event if a registered player provides a replacement player and the replacement player pays in full prior to 30 days before the start of the event.
Responsibility
Yikiti Golf operates as an intermediary for suppliers in selling services not directly supplied by Yikiti Golf, such as accommodations, golfing, etc. No agency relationship exists between Yikiti Golf and its suppliers, and none should be inferred. Yikiti Golf acts on behalf of you, the customer and is not liable for any losses or breaches of contract or any omissions or careless actions on the part of suppliers that may result in any damage, loss, or injury to you for events organized by Yikiti Golf. In the absence of gross negligence on its part, neither Yikiti Golf nor its directors, employees, agents, members, affiliates, or subsidiaries shall be responsible or liable to you for any damages for personal injury or property damage. Nor shall Yikiti Golf be responsible for any substitution of service, changes in fees, schedules or rates by any hotel, resort or golf course, including, but not limited to, cancellation or missed tee times. Furthermore, Yikiti Golf is not now, and shall not become liable or responsible in any way whatsoever for any loss, injury, or damage caused by acts of God, acts of government, pandemics or other entity, wars, civil disturbances, acts of terrorism, hijacks, thefts, or any other circumstances beyond its control. You should note that the suppliers/vendors providing accommodations or services are independent contractors, not agents or employees of Yikiti Golf. Yikiti Golf has the right to alter the itinerary, prices and package features without notice and shall not be responsible for any inconvenience or expense occasioned by such changes.
Indemnification
In addition to the other Terms and Conditions contained herein, to the fullest extent permitted by law, you shall indemnify, defend and hold Yikiti Golf, and its directors, employees, agents, members, affiliates and subsidiaries, harmless from and against all claims, damages, losses, and expenses, whether direct, indirect, or consequential, including but not limited to all fees and charges of attorneys, court and arbitration, resulting from or relating to your actions or omissions.
Insurance
We consider adequate travel insurance to be essential for you when registering for a Yikiti Golf Event. Therefore, Yikiti Golf strongly encourages you to purchase travel insurance. Any policy you purchase should cover as a minimum the cost of cancellation by you, or the full costs that could be incurred in the event of you suffering an accident or illness which would prevent you from fully participating in the event. It is your responsibility to ensure that the insurance coverage you purchase is adequate for your particular needs. We do not check insurance policies. Please read your policy details carefully and take them with you on your event. We do not accept any liability for any possible loss that you suffer as a result of your failure to purchase an adequate insurance policy.
Contract
These Terms and Conditions constitute the complete, final and exclusive binding contract between the parties relating to the Yikiti Golf event you have registered for and supersede all prior agreements, understandings, both written and oral. They may not be amended or altered after your initial deposit has been paid except in writing, signed by all parties.
If any provision or portion of any provision of these Terms and Conditions is held unenforceable or invalid, the validity and enforceability of any remaining provision, or portion of any such provisions shall not be affected, but will remain in full force and effect.
Governing Law, Disputes and Arbitration
These Terms and Conditions and all rights of the parties hereto shall be governed by and construed in accordance with the laws of the State of Nevada. Any claims shall be brought in a court of competent jurisdiction located in Nevada. You agree that you will only bring claims against Yikiti Golf as an individual and not as a plaintiff or class member in a class action or representative proceeding. Reserving a Yikiti Golf event package and sending the initial deposit is and shall constitute the acceptance and ratification of this contract by you.
